Terms of Use and Service Provision

This document governs the use of the King Servers website, as well as the terms for hosting services and technical support.

About This Document

These Terms describe how the King Servers website and services may be used, how orders are placed and paid for, how support is provided, and how disputes are handled. If a specific service has additional rules (tariff terms, an order interface, an invoice, or an agreement), those documents may supplement these Terms.

Section 1

1. General Provisions

Core rules governing service provision, the parties involved, and when the right to demand services arises.

<p>1.1. These Terms of Use and Service Provision (the “Terms”) govern the use of the King Servers website, client interfaces, and services, unless otherwise expressly stated for a specific service, tariff, or document.</p> <p>1.2. The service provider for the purposes of these Terms is King Servers.</p> <p>1.3. Under these Terms, King Servers grants the Customer the right to demand the provision of information processing, hosting, data placement, computing resources, and application access services to the extent and under the conditions of the selected plan, and the Customer undertakes to pay for the relevant services in full and on time.</p> <p>1.4. The right to demand the provision of services arises upon receipt of full payment, unless another service commencement date is established by the selected plan, invoice, specification, or an individual agreement between the parties.</p>

3. Website Content and Limitation of Liability

The website is provided on an “as is” basis, and external links remain outside King Servers’ control.

<p>3.1. King Servers takes reasonable measures to place accurate, complete, and up-to-date information on the website. At the same time, the information on the website is provided on an “as is” basis, and King Servers does not guarantee the absence of inaccuracies, technical errors, misprints, or outdated information.</p> <p>3.2. King Servers may at any time, without prior notice, change the website content, service descriptions, technical parameters, tariffs, restrictions, and other information posted on the website.</p> <p>3.3. Links to third-party resources are provided solely for user convenience. King Servers does not control the content of such resources and is not responsible for their availability, security, accuracy, currency, or legality.</p> <p>3.4. The user is solely responsible for choosing how to use the website, verifying downloaded materials, and taking measures to protect their devices, data, and software from viruses, malicious code, and other threats.</p> <p>3.5. To the maximum extent permitted by applicable law, King Servers shall not be liable for indirect, incidental, consequential, punitive, or special damages, as well as lost profits, data loss, business interruption, or other losses arising from the use of the website or the inability to use it, except in cases of intent or gross negligence on the part of King Servers.</p>

4. Software Available for Download

Software may be used only within the scope of the applicable license and EULA.

<p>4.1. Any software available for download from King Servers resources (the “Software”) is the intellectual property of King Servers and/or the relevant suppliers and rights holders.</p> <p>4.2. Use of such Software is permitted solely within the scope of the applicable end-user license agreement (EULA), if such agreement accompanies the Software or is otherwise made available to the user.</p> <p>4.3. Unless expressly provided otherwise by the applicable license, the Software is supplied for installation and use by the end user solely for personal or internal operational purposes.</p> <p>4.4. Any reproduction, decompilation, redistribution, publication, mirroring, or other use of the Software in violation of the applicable license is prohibited and may result in civil, administrative, or criminal liability.</p>

5. Trademarks

Brand elements are protected by law, and references to third-party brands do not imply affiliation.

<p>5.1. The King Servers name, logos, service names, and other brand elements are means of individualization protected by law.</p> <p>5.2. Mention of third-party trademarks, trade names, or designations on King Servers websites does not mean that King Servers has acquired any rights to such objects and must not be construed as a statement of affiliation unless expressly stated otherwise.</p>

6. Communications and Marketing Mailings

Service notifications are part of support and account maintenance, while marketing messages may be opted out of.

<p>6.1. A user who contacts customer support, sends messages to email addresses in the @king-servers.com domain, or initiates a support chat on the website agrees to receive service notifications related to the processing of the request, service delivery, and account maintenance.</p> <p>6.2. If applicable law allows marketing messages to be sent on the basis of such consent, the user may also receive informational and marketing mailings from King Servers until they opt out.</p> <p>6.3. The user may opt out of marketing messages at any time using the method indicated in the relevant email or by contacting support.</p>

7. Suggestions and Feedback

Ideas and comments are treated as feedback without confidentiality obligations unless otherwise agreed in writing.

<p>7.1. Any comments, ideas, suggestions, remarks, or other information sent by the user to King Servers in connection with the operation of the website, the quality of services, or service development shall be treated as feedback.</p> <p>7.2. Unless otherwise agreed in writing by the parties, such feedback is provided without confidentiality obligations and without any obligation on the part of King Servers to pay the user any compensation.</p> <p>7.3. The user confirms that they are entitled to provide such feedback and grants King Servers the right to use it for the purposes of developing, improving, testing, supporting, and enhancing services to the extent consistent with applicable law.</p>

8. Monitoring, Security, and Acceptable Use

Describes infrastructure monitoring and the list of prohibited use cases.

<p>8.1. King Servers is not obliged to carry out permanent monitoring of materials posted or transmitted by users unless otherwise required by law, the terms of the service, or the need to ensure infrastructure security.</p> <p>8.2. At the same time, the user agrees that King Servers may carry out selective or systematic monitoring of infrastructure, logs, network activity, configurations, and hosted content for the purposes of:</p> <ul> <li>ensuring the stable and secure operation of services;</li> <li>verifying compliance with law, these Terms, and other mandatory rules;</li> <li>preventing abuse, attacks, unauthorized access, and other threats;</li> <li>protecting the rights and legitimate interests of King Servers, its customers, and third parties.</li> </ul> <p>8.3. Access to King Servers management systems, accounts, administrative panels, and applications is granted only to authorized users within the scope of their assigned permissions.</p> <p>8.4. Any actions showing signs of unauthorized access, data modification, interference with infrastructure, circumvention of restrictions, security violations, or unlawful use of resources may be recorded and used as evidence for internal investigation, reporting to competent authorities, or protecting King Servers’ rights.</p> <p>8.5. The user is prohibited from installing, using, or maintaining software intended for mass email distribution, including but not limited to PowerMTA, MailerQ, and other similar solutions. The list of such software may be expanded without prior notice.</p> <p>8.6. If prohibited software is detected as installed or used, King Servers may restrict access to the service, suspend the provision of the service, or block the server without refund of unused funds, unless otherwise required by mandatory provisions of applicable law.</p> <p>8.7. The user is prohibited from using server resources for mining, digital currency infrastructure operation, block creation, transaction validation, or other similar compute-intensive operations unless such use is expressly agreed upon separately by the parties.</p> <p>8.8. Installation, storage, use, publication, or distribution of malicious code, unauthorized access software, botnet components, attack delivery tools, or any other information or software capable of harming King Servers, its customers, or third parties is prohibited.</p>

9. AI Inference and API Services

Defines customer responsibilities, service limits, output disclaimers, and change rights for AI inference and API access.

<p>9.1. King Servers may provide hosted AI inference endpoints, API access to machine learning models, and related infrastructure services. Such services may be provided directly by King Servers or through integrations with third-party platforms.</p> <p>9.2. Customer is responsible for all content submitted to AI inference services, including prompts, input data, files, API requests, and instructions. Customer must ensure that such use complies with applicable law, these Terms, and any applicable acceptable use policies.</p> <p>9.3. AI inference services may be subject to model-specific limitations, rate limits, capacity limits, availability limitations, and technical changes. King Servers may limit, suspend, throttle, or reject requests in cases of overload, abuse, security risk, policy violation, or operational necessity.</p> <p>9.4. King Servers does not guarantee that AI-generated outputs will be accurate, complete, reliable, lawful, or suitable for any particular purpose. Customer is responsible for reviewing and validating outputs before relying on them, especially in business-critical, legal, financial, medical, security, or other high-impact contexts.</p> <p>9.5. King Servers does not use customer prompts, completions, or API request content for model training unless expressly agreed otherwise in writing. Data processing, logging, and retention for AI inference services are described in the <a href="/en/privacy-policy">King Servers Privacy Policy</a> and any applicable service-specific documentation.</p> <p>9.6. King Servers may modify, replace, suspend, or discontinue specific models, endpoints, or AI inference features where required for security, compliance, provider availability, technical stability, or operational reasons.</p>

Section 10

10. Server Connectivity and Network Restrictions

Regulates diagnostics of SSH/RDP inaccessibility and cases where IP replacement or refunds are unavailable.

<p>10.1. If, after a server has been provisioned, the user cannot connect to it via standard TCP ports 22 (SSH) or 3389 (RDP), the King Servers technical department will diagnose the cause of the inaccessibility.</p> <p>10.2. If diagnostics show that the inaccessibility is caused by technical reasons on the King Servers infrastructure side, the company may, at its discretion, resolve the issue or provide a free replacement IP address with another available address.</p> <p>10.3. If the inability to connect is caused by third-party actions, the user’s provider restrictions, governmental actions, routing specifics, traffic filtering, or other external circumstances beyond King Servers’ control, no IP replacement or refund shall be provided unless otherwise required by mandatory legal rules or a separate agreement.</p> <p>10.4. If the server remains reachable from most points of the global network and the issue is observed only by a specific user or a limited number of persons for reasons beyond King Servers’ control, such a situation shall not in itself be deemed improper performance of the service.</p>

Section 11

11. Service Termination and Settlements

Describes service cancellation, refund rules, and recalculation mechanics.

<p>11.1. To cancel a service or discontinue using it, the Customer must send the relevant notice through the client support system or by another method provided by the service rules.</p> <p>11.2. Unless otherwise expressly provided by the tariff, public offer, special promotion, money-back guarantee, or an individual agreement between the parties, paid funds for the already granted right to demand services are non-refundable.</p> <p>11.3. In cases where settlement between the parties must be based on actually incurred costs, the cost shall be determined in accordance with the rules in force at King Servers on the date of service termination, unless another settlement procedure is established by a supplemental agreement between the parties.</p> <p>11.4. To avoid ambiguity, it is recommended that refund, recalculation, retention, and compensation procedures be fixed in tariff terms or a separate document applicable to the specific service.</p>

12. Payment Specifics

Takes into account compliance, payment restrictions, and prohibitions for certain jurisdictions.

<p>12.1. Where required by applicable law, payment system rules, sanctions restrictions, or internal compliance procedures, King Servers may restrict certain payment methods or refuse their use.</p> <p>12.2. In particular, the company does not accept cryptocurrency payments from customers in the United States.</p> <p>12.3. The user must independently choose an available and lawful payment method from among those offered by King Servers for the relevant jurisdiction.</p>

Section 13

13. Dispute Resolution and Governing Law

The governing law depends on the jurisdiction of the servicing company and the nature of the service.

<p>13.1. The relationship between the parties shall be governed by the law of the jurisdiction expressly stated in the contract, invoice, tariff, service rules, or otherwise derived from the status of the servicing company and the nature of the service provided.</p> <p>13.2. If a dispute cannot be resolved through negotiations and pre-trial claims, it shall be considered by the competent court in accordance with the applicable procedural and substantive law.</p> <p>13.4.
