Terms of Use and Service Provision

These Terms of Use and Service Provision define the procedure for using the King Servers website, client account, virtual and dedicated hosting services, and other services provided by the company.

By using the website, registering an account, placing an order, paying for a service, or continuing to use King Servers services, the Client confirms that they have read these Terms, understand their content, and accept them in full.

If the Client does not agree with these Terms, the Client must stop using the King Servers website, client account, and services.

Section 1

1. General Provisions

King Servers provides infrastructure services for hosting websites, applications, databases, corporate systems, gaming projects, development services, test environments, and other digital projects of the Client.

King Servers services may include virtual servers, dedicated servers, additional IP addresses, backup services, technical support, administration on request, DDoS protection, and other services available for ordering on the website or in the client account.

The specific scope of the service, technical specifications, price, billing period, available options, and management procedure are indicated on the website, in the client account, in the invoice, order, or another document related to the service order.

These Terms apply to all Clients unless otherwise provided by a separate contract, appendix, specification, service level agreement, or individual terms agreed between the parties.

2. Registration and Account

To order and manage services, the Client may use the client account. During registration, the Client undertakes to provide accurate information and keep it up to date.

The Client is solely responsible for the security of account credentials, passwords, access keys, server connection details, and any other information that enables service management.

All actions performed through the Client's account are deemed to have been performed by the Client unless proven otherwise. In case of loss of access, suspected account compromise, or unauthorized use of services, the Client must immediately contact support.

King Servers may request additional information from the Client to confirm account ownership, restore access, process payments, comply with legal requirements, or ensure infrastructure security.

3. Ordering and Provision of Services

Services are provided after an order is placed and payment is received, unless another procedure is specified on the website, in the client account, or in individual terms.

The service activation time depends on the type of server ordered, the selected configuration, equipment availability, payment method, and the need for additional verification. Some services may be activated automatically, while others may be activated manually by King Servers specialists.

After service activation, the Client receives access to server management details, the panel, console, IP addresses, or other information required to use the service.

The Client must independently verify the correctness of the ordered configuration, access details, and service parameters after activation. If errors or discrepancies are found, the Client must contact support.

4. Virtual Servers

The virtual server service provides the Client with the ability to use computing resources in a virtual environment. Depending on the selected plan, the Client is allocated CPU resources, RAM, disk space, IP addresses, network bandwidth, and other parameters.

The Client independently manages the operating system, installed software, security settings, network rules, users, files, databases, and hosted services.

King Servers is responsible for the operation of the virtualization infrastructure, physical equipment, network infrastructure, and other components within the company's area of responsibility. At the same time, operating system configuration, application administration, website maintenance, and maintenance of the Client's software are not included in the basic service unless ordered separately.

Section 5

5. Dedicated Servers

The dedicated server service provides the Client with the ability to use a physical server or its agreed configuration for hosting the Client's own projects and services.

The dedicated server configuration, including CPU, RAM, disks, network parameters, additional IP addresses, and other characteristics, is specified when ordering or agreed separately with the Client.

Changing the dedicated server configuration may require technical work, coordination of timing, temporary service unavailability, or additional payment. The ability to change parameters depends on equipment availability and technical limitations.

The Client is responsible for operating system and software administration unless otherwise provided by a separate technical support service.

6. Service Management

Services are managed through the client account or through support requests if a particular operation is not available for self-service.

In the client account, the Client may view active services, invoices, payments, renewal dates, service parameters, request history, and other information related to service management.

For certain services, options may be available to change parameters, reinstall the operating system, reboot, manage access, obtain console connection details, or perform other actions.

The Client understands that certain actions in the client account may cause a server reboot, configuration changes, data loss, or temporary service unavailability. Before performing such actions, the Client must independently assess the risks and create a backup copy of data if necessary.

7. Areas of Responsibility

King Servers' area of responsibility includes data center infrastructure, power supply, climate control, physical equipment security, network equipment, internet access channels, server equipment, and other components used to provide the service.

For virtual servers, King Servers' area of responsibility also includes the hypervisor and the virtual machine as an object of the virtualization infrastructure.

The Client's area of responsibility includes the operating system, software, websites, applications, databases, firewall settings, accounts, passwords, SSH keys, licenses, hosted content, backups, and ensuring the information security of the services used.

King Servers is not responsible for failures caused by the Client's actions, configuration errors, software incompatibility, malware infection, loss of passwords, incorrect network rule configuration, file deletion, actions of third parties using the Client's access credentials, or other circumstances outside King Servers' area of responsibility.

Section 8

8. Technical Support

King Servers provides technical support for matters related to infrastructure operation, service availability, payment, renewal, basic service management, and incident handling.

Support requests are accepted through the client account, Helpdesk system, or official contacts specified on the website. For proper request processing, the Client must provide the service number, problem description, time of occurrence, error messages, diagnostic results, and other information required for analysis.

The response time depends on the request category, priority, impact on the service, and scope of required work. Requests related to full or partial service unavailability caused by reasons within King Servers' area of responsibility are processed first.

Requests related to configuring the Client's software, data migration, installation of non-standard components, application configuration, diagnostics of third-party services, website optimization, or other work outside basic support may be performed on a paid basis after the cost and timing are agreed.

King Servers does not process by phone requests for providing access credentials, changing the service owner, deleting or adding services, or changing critical parameters if such actions require confirmation through the client account or from the Client's official contact address.

Section 9

9. Request Categories

Client requests may belong to one of the following categories: incident, service request, change request, or information request.

An incident means a malfunction, equipment failure, infrastructure disruption, or another event that caused deterioration in service quality or full or partial service unavailability.

A service request means a request related to standard actions within the provided service, provided it is not caused by an accident or infrastructure failure.

A change request means a request that changes the scope of the service, configuration, resource volume, additional options, or other service parameters.

An information request means a request related to receiving data about the service, payments, traffic, parameters, reports, or other information available to the Client as part of service management.

Section 10

10. Monitoring and Service Availability

King Servers monitors the infrastructure within the company's area of responsibility. Monitoring may include checking equipment status, network infrastructure, virtualization platform, and other systems required to provide the service.

King Servers does not continuously monitor the network availability of the Client's operating system, installed applications, websites, databases, user processes, or other software hosted on the Client's server unless such service is ordered separately.

A service is considered unavailable only in case of confirmed unavailability caused by a reason within King Servers' area of responsibility. If King Servers infrastructure operates correctly but the service is unavailable due to the Client's settings, blocks, operating system errors, software, firewall, DNS, routing on the side of third parties, or other external reasons, such situation is not considered an availability breach by King Servers.

If the service is available within King Servers' area of responsibility but unavailable from certain internet network segments, such situation is not considered full service unavailability if the cause is outside King Servers infrastructure.

Section 11

11. Maintenance Work

King Servers may perform scheduled maintenance required to maintain infrastructure stability, security, and performance.

Maintenance may include equipment upgrades, component replacement, network infrastructure configuration, security system updates, virtualization platform maintenance, routing changes, and other technical actions.

King Servers notifies Clients of scheduled maintenance in advance if the nature of the work allows such notification. Whenever possible, work is performed during periods of lowest load.

In case of accidents, critical vulnerabilities, security threats, DDoS attacks, or other circumstances requiring urgent intervention, King Servers may perform unscheduled work without prior notice or with a shortened notice period.

Scheduled maintenance time is not included when calculating service availability and compensation unless otherwise provided by a separate agreement.

Section 12

12. Backups

The Client is solely responsible for creating, checking, and storing backups of their data unless a backup service is ordered separately.

If a backup option is available for the service, the Client independently enables it in the client account or through support. The availability of the backup service, backup frequency, retention period, and restore terms depend on the selected service and its parameters.

King Servers does not guarantee data recovery if no backup exists, the backup was deleted, damaged, created with an error, not enabled by the Client, or if the backup retention period has expired.

The Client must independently verify backup correctness, especially before performing critical operations: system reinstallation, configuration changes, file deletion, software updates, project migration, or service termination.

Section 13

13. Data Recovery

Data recovery is possible only if an up-to-date backup exists or if the server has been blocked but not yet removed from the infrastructure.

If the service rental period has ended and the Client did not renew it on time, recovery availability depends on the service status, time elapsed since the end of the rental period, availability of backups, and technical possibility of recovery.

King Servers may refuse data recovery if recovery is technically impossible, if no backup exists or the backup is damaged, if the data was deleted after the retention period expired, or if the service was permanently removed.

Data recovery after the end of the rental period may be provided for an additional fee if this is provided by service rules and is technically possible.

Section 14

14. Payment for Services

King Servers services are provided on a prepaid basis unless otherwise agreed separately. The Client must pay for and renew services on time to avoid suspension, blocking, or deletion.

Service prices are indicated on the website, in the client account, in an invoice, or in an individual offer. The final price may depend on the selected configuration, billing period, additional options, number of IP addresses, licenses, support level, and other parameters.

The payment obligation is considered fulfilled after funds have actually been received and correctly credited to the Client's balance or account.

If a payment was sent but not credited, the Client must contact support and provide payment confirmation. Until receipt of funds is confirmed, King Servers is not obligated to activate or renew the service.

Section 15

15. Renewal, Suspension, and Deletion of Services

The Client independently monitors service expiration dates and is responsible for timely renewal.

If payment is not made, King Servers may suspend service provision, restrict access to the server, disable the service, block management, or delete the service and related data after the established retention period expires.

Service suspension does not release the Client from the obligation to pay debt if it arose under ordered services or agreed obligations.

After service deletion, recovery of the server, files, databases, settings, IP addresses, and other data may be impossible. The Client must save all necessary data and backups in advance.

Section 16

16. Refunds and Service Cancellation

The refund procedure depends on the type of service, time of request, whether the service has been activated, used period, incurred costs, and other terms applicable to the specific order.

A refund may be unavailable for services that have already been activated, configured according to the Client's individual configuration, used by the Client, or require allocation of unique equipment, IP addresses, licenses, or other non-refundable resources.

To request a refund review, the Client must contact support and specify the order number, service, reason for the request, and payment details required to identify the payment.

King Servers may refuse a refund if the service was properly provided, used by the Client, or if refusal of refund is provided by the terms of the specific service.

Section 17

17. Acceptable Use of Services

The Client undertakes to use King Servers services only for lawful purposes and not to allow actions that may violate law, rights of third parties, network rules, requirements of data centers, registrars, payment systems, or these Terms.

It is prohibited to use King Servers services for sending spam, phishing, hosting malware, operating botnets, conducting network attacks, scanning third-party systems without authorization, password cracking, distributing illegal content, copyright infringement, fraud, or other actions that may harm King Servers, other clients, or third parties.

The Client is fully responsible for all content hosted on the server, as well as for actions of users, applications, scripts, and programs operating within the Client's service.

If complaints, notices, abuse reports, rights holder requests, messages from data centers, network operators, or government authorities are received, King Servers may request explanations from the Client, require the violation to be remedied, temporarily restrict service operation, or block the service until the circumstances are clarified.

Section 18

18. Information Security

The Client must independently ensure the security of their servers, services, accounts, passwords, SSH keys, control panels, databases, websites, and applications.

The Client is advised to use strong passwords, two-factor authentication where possible, up-to-date software versions, regular security updates, firewall, IP-based access restrictions, backups, and monitoring of their own services.

King Servers is not responsible for the consequences of a Client's server compromise if it occurred due to weak passwords, vulnerable software, incorrect configuration, publication of access credentials, actions of third parties, or absence of necessary security measures on the Client's side.

Section 19

19. DDoS Attacks and Network Incidents

King Servers may provide DDoS protection services within selected plans or additional options. The protection level, parameters, limitations, and operating terms depend on the specific service.

During a DDoS attack, short-term service unavailability, routing changes, traffic filtering, temporary restrictions, or other technical measures required to protect the infrastructure may occur.

King Servers does not guarantee complete protection against all types of attacks, especially if an attack exceeds the technical protection parameters, requires additional filter training, or is related to non-standard traffic types.

If the Client's actions, software, or hosted content threaten the stability of the network, equipment, or other clients, King Servers may temporarily restrict the service until the cause is eliminated.

Section 20

20. Compensation for Unavailability

Compensation for service availability breach may be provided only in cases where unavailability occurred due to King Servers' fault and is confirmed by monitoring tools or technical inspection results.

Compensation is not provided for unavailability caused by the Client's actions, configuration errors, failures of the Client's software, DDoS attacks exceeding established parameters, actions of third parties, external network issues, scheduled maintenance, unscheduled emergency work, or force majeure circumstances.

To request compensation review, the Client must contact support within the established period, specify the service and unavailability period, and provide available information about the issue.

The form, amount, and calculation procedure for compensation are determined by the service level agreement or terms of the specific service. Compensation may be provided as an extension of the service term or in another form provided by service rules.

Section 21

21. Limitation of Liability

King Servers is not liable for the Client's losses caused by data loss, project downtime, reduced profit, disruption of websites, applications, databases, software, or third-party services if such consequences arose outside King Servers' area of responsibility.

The Client understands that use of server infrastructure involves technical risks, including software failures, administration errors, network incidents, DDoS attacks, actions of third parties, and other circumstances.

King Servers' liability is limited to the cost of the specific service and the compensation terms provided by the service level agreement unless otherwise established by mandatory legal requirements.

Section 22

22. Personal Data and Confidentiality

King Servers processes the Client's data to the extent necessary for registration, service provision, payment processing, technical support, compliance with legal requirements, security, and communication with the Client.

The Client undertakes to provide accurate data and update it in a timely manner if it changes. King Servers is not responsible for inability to contact the Client if the Client provided incorrect or outdated contact information.

Information about the Client, services, and requests is not disclosed to third parties except when necessary to provide services, comply with legal requirements, process payments, protect King Servers' rights, or prevent violations.

Section 23

23. Changes to Terms and Prices

King Servers may change these Terms, prices, service scope, technical parameters, available options, usage rules, and service provision procedure.

The current version of the Terms is published on the King Servers website. Continued use of services after publication of an updated version means the Client agrees to the changes.

If the Client does not agree with the changes, the Client may stop using the services in accordance with these Terms and the terms of the specific service.

Section 24

24. Termination of Services

The Client may refuse a service by stopping its use and not renewing it for the next billing period, unless otherwise provided by individual terms.

King Servers may suspend or terminate services if the Client violates these Terms, fails to pay, receives substantiated complaints, creates a threat to infrastructure, violates law, or uses services for prohibited purposes.

Service termination may result in deletion of data, settings, IP addresses, and other information related to the service. The Client must save all necessary data in advance.

Section 25

25. Force Majeure

King Servers is not liable for full or partial non-performance of obligations if it is caused by force majeure circumstances, including accidents on external networks, actions of government authorities, natural disasters, military actions, mass communication failures, fires, power outages, large-scale DDoS attacks, actions of third parties, and other circumstances that could not reasonably be foreseen or prevented.
